I would like to trademark a my website name for business use. I have confirmed it is unique via multiple Google searches and have owned the domain name and website for a few years. There are no other businesses with similar names.
Are online trademark services, such as Xpressmark or Trademark Genius worthwhile? The process of filling out the paperwork correctly seems the be the most difficult part (other than the 18 month wait).
These online services review the paperwork on your behalf to avoid rejection, some will have their attorneys review the application. Costs are from $35 to $300 + USPTO filing fees of $250 - $350, and other fees later on.
To me it seems online is a way to go but I am not sure if there is any catch with these services. I just need someone to review the documents, make sure they are fine, and submit them. I don't feel comfortable filing myself only to be rejected 9 months later and an attorney would charge me untold thousands for something I think is pretty simple.
Bonus question: If I submit my application, does anyone submitting for the same name during the pending and review period lose out since I was first to file?
